Terms of Sale
Elevoria OÜ terms of sale. In effect from 5 March 2025.
1. General information
1.1. These terms of sale (hereinafter the "Terms") govern the legal relationship between Elevoria OÜ (registry code 17129519, address Harju county, Harku parish, Tiskre village, Välja tee 19/1-1, 76916, Estonia, email kaija@kaijaalliksaar.ee, hereinafter the "Seller") and the buyer (hereinafter the "Client") arising in connection with the purchase of digital content on the Seller's website https://www.kaijaalliksaar.ee.
1.2. The Seller offers Clients digital content consisting of training videos (in streaming form, not downloadable) and downloadable supplementary materials (e.g. PDF files).
1.3. Agreeing to the Terms is a precondition for making a purchase. By completing a purchase, the Client confirms that they have read and agreed to the Terms.
2. Product description
2.1. The Seller offers the following products. Training videos: digital content in streaming form, available online. The videos are not downloadable, and the right to view them is valid for 6 months from the date of purchase. Supplementary materials: downloadable files (e.g. documents in PDF format) that become available to the Client after the purchase is made.
2.2. The exact content, price and other details of a product are given in the product description on the website at the time of purchase.
3. Purchase process
3.1. The Client selects the desired product on the website and adds it to the cart.
3.2. To complete the purchase, the Client fills in the required data fields (e.g. name, email) and chooses a payment method.
3.3. After the payment is made, the Client receives an email confirmation of the purchase and access to the digital content in accordance with the Terms.
3.4. The Seller reserves the right to refuse a purchase if the Client breaches the Terms or provides false information.
4. Price and payment
4.1. All prices are shown in euros (€).
4.2. Payment is made through the payment methods offered by the Seller. Processing of payments is the responsibility of a third party (the payment service provider).
4.3. After the payment is received, the Seller issues the Client an invoice by email.
5. Access to digital content
5.1. Training videos are made available to the Client via online streaming. Access to the videos is valid for 6 months from the date of purchase, after which access ends automatically.
5.2. Supplementary materials (e.g. PDF files) are downloadable by the Client after the purchase is completed, either in the account area ("My account") on the Seller's website or via a link sent with the purchase confirmation.
5.3. The Client undertakes not to share, copy or distribute the purchased digital content to third parties. The content is intended solely for the Client's personal use.
6. Right of withdrawal
6.1. As this is digital content that is made available to the Client immediately after purchase, the 14-day right of withdrawal under section 53(4)(4) of the Estonian Law of Obligations Act does not apply, provided the Client has given prior consent to this and confirmed that they are aware of losing the right of withdrawal.
6.2. By completing the purchase, the Client confirms that they agree to immediate access to the digital content and to the loss of the right of withdrawal.
7. Intellectual property
7.1. All training videos and supplementary materials are the intellectual property of Elevoria OÜ and are protected by copyright.
7.2. The Client has the right to use the content for personal purposes, but reproducing, distributing or otherwise using it commercially without the Seller's written consent is prohibited.
8. Liability
8.1. The Seller is responsible for the availability of the digital content in accordance with the Terms. The Seller is not liable for technical faults arising from the Client's devices or internet connection.
8.2. The Client is responsible for the security of their account and undertakes to notify the Seller without delay if they suspect unauthorised access.
9. Complaints and disputes
9.1. The Client has the right to submit complaints about the digital content within 14 days of making the purchase, by sending a written notice to kaija@kaijaalliksaar.ee.
9.2. The Seller responds to a complaint within 14 days. If a dispute is not resolved through negotiation, it is settled in accordance with the laws of the Republic of Estonia in Harju County Court.
9.3. In the event of a consumer dispute, the Client may turn to the Estonian Consumer Protection and Technical Regulatory Authority (www.ttja.ee).
10. Amendments to the Terms
10.1. The Seller has the right to unilaterally amend the Terms, notifying Clients of changes on the website at least 14 days in advance. Amendments do not affect purchases already made.
